With the rapid development and spread of the Internet in recent years, copyright issues on the Internet have become increasingly prominent and become a focus of attention in the international intellectual property field. Since 2005, the NCAC has carried out Jianwang Campaign with the Ministry of Public Security, Ministry of Industry and Information Technology, and State Internet Information Office to combat online infringement and piracy. This campaign has significantly improved the Internet copyright protection environment and been recognized by copyright owners at home and abroad.
1.Jianwang Campaign has achieved remarkable results. Jianwang Campaign focuses on investigating and dealing with major cases, during which efforts are ramped up to address online infringement and piracy in key areas such as online literature, music, videos, games, animation, and software. According to statistics, relevant departments such as copyright, public security, and telecommunications departments investigated and dealt with 5,578 cases related to Internet infringement and piracy during 2005 to 2016, including a legal shutdown of 3,079 pirate sites, the confiscation of 2,230 servers and related devices and the imposing of fines up to RMB 20.52 million. Among the cases, 480 cases were handed over to judicial organs for criminal prosecution. The cases included those with a hugely negative impact on society, including OpenV.com’s film and TV series infringement, Tomato Garden website’s infringement, 6621.com’s music works infringement, and emgog.com literary works infringement cases. In 2016, Jiangsu and Beijing law enforcement agencies conducted a joint investigation on the “10.26” (October 26) exceptionally serious case of the sale of pirated books online and arrested 42 suspects. This was the resolved case in which the largest number of pirated books were sold via Taobao.com and the maximum amount was involved in recent years. This case involved 1.2 million pirated books whose total fixed price exceeded RMB 52 million. In 2016, Beijing law enforcement agency investigated and dealt with the “8.08” (August 8) extraordinarily serious case of the production and sale of pirated children’s publications and seized allegedly infringing children's publications of more than 3.5 million copies under 946 categories with a total fixed price of more than RMB 91 million. This case was the one with the worst social impact involving a huge amount of money for the greatest number of pirated children’s publications of the most categories in recent years. This campaign, through case investigations, crackdown of pirate sites, and punishments and sanctions, has effectively deterred online infringement and piracy.
2.Targeted network regulation has produced positive results. While cracking down on a variety of online infringement and piracy activities, the NCAC has been working to strengthen the regulation of influential Internet companies since 2009. At present, copyright authorities focus on the regulation of 3,029 key websites, of which the NCAC directly supervises 20 major video sites, 20 major music sites, 20 online literature companies and 8 network disk companies (including influential Internet companies such as Baidu, Youku, Tudou, iQIYI, Tencent, Sohu, Sina, and Thunder). The copyright authorities take the initiative to check the spread of film and television works on the key sites and start an early warning system for the copyright protection of film and television works. They also help the sites establish and improve copyright management systems and urge the companies in the web industry to uphold integrity and strengthen self-discipline. Targeted network regulation has significantly changed a chaotic landscape where copyright infringement often occurs on video, music, and literature sites and dramatically increased the percentage of copyrighted works on these sites.
3.The public awareness on copyright has been raised through increased publicity. During the “4.26 National IPR Publicity Week” in 2016, 31 provinces, autonomous regions and municipalities were organized to carry out the activity of destructing 14.18 million pirated and illegal publications in a centralized manner. Copyright publicity channels have been expanded through the release of Annual National Top Ten Infringement and Piracy Cases and China Network Copyright Protection Annual Report and through ways such as relevant websites, microblogs, WeChat and public service posters. All these efforts have helped expand the social influence of copyright protection work, raise public awareness on copyright, and create a public opinion environment favorable to copyright protection.
